Democratic Rep. Eric Swalwell of California is suing former President Donald Trump and his allies over the Capitol riot. Swalwell claims that the unrest in Washington, D.C., on Jan. 6 caused him to suffer from “severe emotional distress.”

The civil lawsuit, filed Thursday in federal court in Washington, alleges that Trump and his allies are “responsible for the injury and destruction” from the riot at the U.S. Capitol. The suit targets Trump, his personal attorney Rudy Guiliani, Donald Trump Jr., and Republican Rep. Mo Brooks of Alabama for their alleged roles in January’s violence at the Capitol.

“Donald Trump, his son Donald Trump Jr., his advisor Rudy Giuliani, and Congressman Mo Brooks, together with many others, defiled that sacrament through a campaign of lies and incendiary rhetoric, which led to the sacking of the United States Capitol on January 6, 2021,” the lawsuit reads.

The 65-page complaint claims that the defendants engaged in “conspiracy to violate civil rights,” “neglect to prevent interference with civil rights,” “incitement to riot,” “inciting assault,” “disorderly conduct,” and “terrorism.”

“In claiming for weeks that President Biden’s victory was in fact the largest act of fraud in American history; in seeing that some of Trump’s supporters were willing to engage in violence in response to such claims; and in using highly inflammatory language in repeating the false claims of fraud at the rally before sending the crowd to the Capitol, the Defendants at a minimum acted negligently,” the complaint alleges.

The suit alleges that the defendants “by force, intimidation, or threat, agreed and conspired among themselves and with others to prevent members of Congress, including the Plaintiff, and Vice President Mike Pence from counting the Electoral College Votes and certifying President Biden and Vice President Harris as the winners of the 2020 presidential election.”

The lawsuit also sues all four defendants for “infliction of emotional distress” over the Capitol riot.

“Defendants intentionally, or at a minimum recklessly, caused the severe emotional distress suffered by the Plaintiff in connection with the January 6 attack,” the complaint states. “Defendants are furthermore vicariously liable for, and aided and abetted, the rioters’ negligent infliction of emotional distress upon the Plaintiff.”

The lawsuit claims that Swalwell “took off his jacket and tie” to prepare to engage in a physical altercation against the crowd who had infiltrated the Capitol building.

“The Plaintiff prepared himself for possible hand-to-hand combat as he took off his jacket and tie and searched for makeshift instruments of self-defense,” the lawsuit claims. “He listened in shock as the House Chaplain — a veteran of war herself — began praying for the members from the Rostrum. As the Plaintiff watched this horror unfold, he texted with his wife in what he felt could be his last moments, telling her ‘I love you very much. And our babies.'”

The lawsuit seeks monetary damages against the defendants, including punitive damages.

Trump spokesman Jason Miller told Reuters that Swalwell “is a low-life with no credibility.”

Swalwell served as one of the impeachment managers prosecuting Trump, who argued that the former president incited violence at the Capitol on Jan. 6. The Senate voted to acquit Trump on Feb. 13.

Rep. Bennie Thompson (D-Miss.), chairman of the House Homeland Security Committee, filed a lawsuit last month against Trump, Giuliani, the Proud Boys, and Oath Keepers over for allegedly conspiring to incite the Capitol riots.

    I would only hope that Trump counter sues Swallwell for spying on the USA. This Swallwell totally disgusts me! He actually should be tried for treason. But, with all three branches of government now falling under Marxism, there will never again be true justice! They will soon be coming for our Second Amendment rights.     Surprise! The ‘Russian Bounty’ Story Hyped Up By Corrupt Media To Hurt Trump Turned Out To Be Fake News

    New reports show that U.S. intelligence had “low to moderate” confidence in a story peddled by leftists and their corrupt corporate media cronies last year. The anonymously sourced story claimed Russia offered members of the Taliban bounties in exchange for killing American soldiers.

    “The United States intelligence community assesses with low to moderate confidence that Russian intelligence officers sought to encourage Taliban attacks U.S. and coalition personnel in Afghanistan in 2019 and perhaps earlier,” a senior administration official said on Thursday.

    “U.S. intelligence community agencies have low to moderate confidence in this judgment in part because it relies on detainee reporting, and due to the challenging operating environment in Afghanistan, our conclusion is based on information and evidence of connections between criminal agents in Afghanistan and elements of the Russian government,” the official continued.

    Last summer, corporate media outlets ranging from the Washington Post and the New York Times to CNN and MSNBC treated the claim from unnamed intelligence sources as gospel truth and used it to fuel their anti-Trump narratives ahead of the 2020 election. These are the same media outlets that peddled false narratives about the debunked Russia collusion hoax.

    The Daily Beast, which reported the senior official’s comments on Thursday, ran multiple stories about the unproven “scandal” last year.

    A Daily Beast senior editor even mocked Federalist Senior Editor Mollie Hemingway for approaching the bounty claims with caution.

    When former President Donald Trump also dismissed the rumors in an Axios interview, WaPo’s lead “fact-checker” gave the president a “Four Pinocchios” rating for denying the bounty allegations as “fake news.”

    “Reports of Russian bounties targeting U.S. troops have spurred the Defense Department to action, triggered a leak investigation by the Justice Department and continue to be investigated by U.S. officials. By giving a total denial, as if trying to put the cat back in the bag, Trump earns Four Pinocchios,” the article concluded.

    The bounty scandal not only blew up on liberal cable news networks and front pages of increasingly leftist papers, but Democrats and NeverTrumper legislators used the story as justification to reject Trump’s attempt to pull troops out of Afghanistan.

    Even when the media were presented with information that added skepticism to an already shaky narrative, journalists kept the story alive for months, much like the Russia collusion hoax.

    As journalist Glenn Greenwald points out, the first round of reporting on the Russia bounty story was based on unquestioned information from the Central Intelligence Agency.

    In addition to their reporting malfeasance when the story first broke, the corporate media completely overlooked the fact that Democrat Rep. Adam Schiff of California, chairman of the House Permanent Select Committee on Intelligence, was briefed as early as February of last year about the possible bounties but refused to take action at the time.

    As Hemingway and Federalist co-founder Sean Davis wrote at the time, “Schiff is demanding that the Trump administration brief all of Congress about the unverified allegations, yet he himself did not ask for a briefing of the Intelligence Committee following the February briefing of his own staff.”

    The backpedaling by intelligence officials comes the same day that President Joe Biden sanctioned Russia for messing with the 2020 election and potential involvement in major cyberattacks.

    Pelosi Will Not Bring Supreme Court Expansion Bill To A Vote But Won’t Rule Out Court-Packing

    Speaker of the House Nancy Pelosi (D-CA) said in a press conference Thursday that while she will not rule out adding members to the Supreme Court in the future, she will not bring a proposed bill to expand the Court to the floor for a vote.

    Asked whether she planned to bring the bill, reportedly being drafted by House Judiciary Committee chairman Rep. Jerry Nadler (D-NY) and others, to the floor for a vote, Pelosi answered, “No.”

    She later clarified, however, that she has “no plans” to bring the current bill to the floor, but that she “doesn’t know if that’s a good idea or bad idea” to expand the court from 9 to 13 members, and that future a plan to expand the court is “not out of the question.”

    “No. I support the president’s commission to study such a proposal, but frankly, I’m not — right now, we’re back, our members, our committees are working. We’re putting together the infrastructure bill and the rest,” Pelosi said. “I don’t know if that’s a good idea or a bad idea. I think it’s an idea that should be considered and I think the president’s taking the right approach to have a commission to study such a thing. It’s a big step.”

    Pelosi then suggested that packing the court is a legitimate way to break gridlock if Congress is faced with certain “challenges.”

    “It’s not out of the question. It has been done before in the history of our country a long time ago. And the growth of our country, the size of our country, the growth of our challenges in terms of the economy, etc., might necessitate such a thing,” she added.

    The Supreme Court has had exactly 9 justices since 1869. Prior to that, the number fluctuated from 6, at the time of President George Washington, to 5, to prevent then-President Thomas Jefferson from appointing a new justice to the Court, to 10 during President Abraham Lincoln’s tenure. President Franklin Delano Roosevelt tried to “pack” the court by adding 6 judges in the 1930s, but the Senate killed his hopes, shooting down the proposal 70 votes to 20.

    The Court, it appears, has never been expanded to meet the “growth” of the country or because of economic “challenges,” despite Pelosi’s suggestion.

    Democrats have toyed with the idea of “packing” the court since President Donald Trump appointed now-Justice Amy Coney Barrett to replace the late Justice Ruth Bader Ginsburg. The bill unveiled earlier this week would have added four justices, all, it seems, appointed by President Joe Biden.

    The bill is “reportedly being led by House Judiciary Committee Chair Jerry Nadler of New York, Subcommittee Chair Hank Johnson of Georgia, and Rep. Mondaire Jones of New York in the House, while Sen. Ed Markey of Massachusetts is spearheading the bill in the Senate,” according to Business Insider.

    In his first comments confirming the effort, Nadler said that the effort was not designed to “pack” the court but to “unpack” it.

    “We’re not packing the Supreme Court, we’re unpacking it,” he said.

    Liz Cheney Says She Will Not Vote for Trump if He Runs Again in 2024, and He Responds Immediately

    U.S. Rep. Liz Cheney (R-Wyo.), the third-highest ranking Republican in the House, said that if former President Donald Trump ran again for president in 2024 that she would not vote for him, and Trump responded immediately.

    Cheney made the comments at the end of an interview Wednesday on Neil Cavuto’s show on Fox News.

    “Well, look, Neil, I’ve been very clear about my views about what happened on January 6th, about my views of the president’s culpability, I obviously voted to impeach him, I think that it was the gravest violation of an oath of office by any president in American history,” she explained.

    “I think for us as a party, we’ve got to be the party of hope and aspiration, and we cannot embrace insurrection, we can’t minimize what happened on January 6th, and I think that all of us regardless of partisanship, have an obligation and a duty to the Constitution.”

    “If Donald Trump were the 2024 nominee, would you support him?” asked Cavuto.

    “I would not,” said Cheney without pause.

    News of the admission from Cheney, who was one of the few Republican members of Congress to vote to impeach Trump after the U.S. Capitol riot, apparently reached the former president, who released a statement against her about an hour later.

    “[S]o many people many people are looking to run against Crazy Liz Cheney — but we only want one,” read the statement from Trump.

    “She is so far down in Wyoming polls that the only way she can win is numerous candidates running against her and splitting the vote. Hopefully, that won’t happen,” he added. “I’ll make an Endorsement soon!”

    Other vocal critics of Trump have offered differing opinions on a possible 2024 presidential run, including Sen. Mitt Romney (R-Utah) who said that the former president would likely win if he ran again.

    John Boehner, the former Republican Speaker of the House, said that he voted for Trump in 2020 over his “good friend” Joe Biden, but that he would hope to have other alternatives to vote for if Trump ran in 2024.

    Soon after Cheney voted to impeach Trump, the Wyoming GOP party answered by censuring her and demanding her resignation. She also successfully fended off a campaign led by Republican Rep. Matt Gaetz of Florida to have her removed from GOP leadership in February.

    Cheney’s office said that her re-election campaign raised $1.5 million in the first three months of 2021, a record for her fundraising efforts.

    Democrats Introducing Legislation To Pack Supreme Court With 4 New Justices, Report Says

    House and Senate Democrats are reportedly preparing to unveil legislation on Thursday to pack the Supreme Court with four new justices, a move that would change the balance of power on the nation’s highest court.

    “The bill would add four seats to the high court, bringing the total to 13, from the current 9,” The Intercept reported. “The bill is led by House Judiciary Committee Chair Jerry Nadler, Subcommittee chair Hank Johnson, and freshman Rep. Mondaire Jones. In the Senate, the bill is being championed by Ed Markey of Massachusetts.”

    The legislation comes after Democrat President Joe Biden announced last week that he had created a commission to study court packing — a political move that is so controversial that the majority of Americans oppose it — because, according to The New York Times, he was “under pressure from activists.” Before last year’s election, Biden said that voters did not “deserve” to know his stance on packing the courts.

    The Daily Wire reported last week:

    Court packing is so toxic that even socialist Sen. Bernie Sanders (I-VT) does not support it and has warned that if Democrats do it then “the next time the Republicans are in power they will do the same thing.”

    Leftist Supreme Court Justice Stephen Breyer, a registered Democrat, warned this week during a speech at Harvard that packing the court will diminish “confidence in the courts, and in the rule of law itself” which will lead to “diminishing the court’s power, including its power to act as a ‘check’ on the other branches.”

    Even leftist Supreme Court Justice Ruth Bader Ginsburg warned against packing the courts, saying that it will make the court appear more partisan and will trigger a constant expansion of the courts every time there is a power change in Washington, D.C.

    Even former Democrat Senator Harry Reid (NV) warned over the weekend that Democrats better be careful with trying to alter the composition of the Supreme Court.

    “I think it’s — we should be very, very careful in doing so. I have no problem with the commission, but I think that the commission is going to come back and disappoint a lot of people because I think they’re going to come back and say, we should just kind of leave it alone,” Reid said. “I think it would be inappropriate at this time after that long history we’ve had in the country [to] have term limits for judges. I think that we better be very, very careful in saying that we need to expand the Supreme Court. I think we better be very, very, careful.”

    Mike Davis, founder and president of the Article III Project (A3P), warned that Biden’s move was “alarming” and must “be met with the harshest of denunciations from both sides of the aisle” because packing the Supreme Court would lead to “irreversible damage.”

    “Packing the Supreme Court would destroy centuries of hard work from Democrat- and Republican-appointed justices to insulate the high court from partisan politics,” Davis warned. “It also raises serious red flags as to what unconstitutional actions President Biden is planning that a more favorable Supreme Court might tolerate.”

    WATCH: CNN Camera Crew Attacked At Protest With BLM Supporters, Forced To Retreat From Scene

    CNN camera crew members were attacked during a protest where Black Lives Matter supporters gathered outside a police station in Minneapolis on Wednesday evening and were forced to retreat from the scene after repeatedly being assaulted.

    “Man part of CNN crew for CNN reporter @miguelmarquez was hit in the head by a protester at the #BLM protest in Brooklyn Center, Minn,” journalist Andy Ngo, who covers far-left extremism, wrote on Twitter. “He falls to the ground from the assault.”

    Ngo later said that the entire camera crew was “violently chased away from the #BLM protest in Brooklyn Center, Minn.”

    During the violent Black Lives Matter riots that rocked the U.S. last summer, far-left extremists attacked CNN’s headquarters in Atlanta, Georgia, shattering windows and throwing explosives inside the building as law enforcement officials guarded the lobby.

    CNN has repeatedly been the subject of news reports this week for their coverage of far-left riots and for undercover videos that were released that show a director at the network admitting that they create “propaganda” and essentially work to destroy Republicans.

    On Monday night, a man walked up to a CNN reporter who was covering a riot and unloaded on the network, saying the network twists stories.

    “What I think about this, it’s all the press and all the extra s*** y’all do, makes this worse,” the man responded. “When people want to protest, they shouldn’t do it in front of a f***in’ police sta–, yeah, court house, s*** like that. You get what the f*** I’m saying? Y’all need to get up out of here with all that twisting that the media and s***.”

    The man later dismissed the reporter’s comments that they were on live air, saying, “I don’t care if you’re live or not, get away from here with all that media s*** that y’all doing.”

    James O’Keefe’s Project Veritas released multiple undercover videos this week of CNN Technical Director Charlie Chester admitting numerous damaging things about the network and how they cover the news.

    On CNN and its employees working to oust Trump from office, Chester made the following remarks throughout various encounters that he had with an undercover Project Veritas journalist:

    • “Look what we did, we [CNN] got Trump out. I am 100% going to say it, and I 100% believe that if it wasn’t for CNN, I don’t know that Trump would have got voted out…I came to CNN because I wanted to be a part of that.”
    • “It’s going to be our [CNN’s] focus. Like our focus was to get Trump out of office, right? Without saying it, that’s what it was, right? So, our next thing is going to be climate change awareness.”

    On CNN creating “propaganda” to damage Trump, Chester said:

    • “[Trump’s] hand was shaking or whatever, I think. We brought in so many medical people to tell a story that was all speculation — that he was neurologically damaged, and he was losing it. He’s unfit to — you know, whatever. We were creating a story there that we didn’t know anything about. That’s what — I think that’s propaganda.”

    On having a predetermined agenda to cover climate change and to use “fear” to sell it, Chester said:

    • “I think there’s a COVID fatigue. So, like whenever a new story comes up, they’re [CNN’s] going to latch onto it. They’ve already announced in our office that once the public is — will be open to it — we’re going to start focusing mainly on climate.”
    • “I have a feeling that it’s going to be like, constantly showing videos of decline in ice, and weather warming up, and like the effects it’s having on the economy–”
    • Climate change is the next “pandemic-like story that we’ll beat to death, but that one’s got longevity. You know what I mean? Like there’s a definitive ending to the pandemic. It’ll taper off to a point that it’s not a problem anymore. Climate change can take years, so they’ll [CNN will] probably be able to milk that quite a bit.”
    • “Be prepared, it’s coming. Climate change is going to be the next COVID thing for CNN.”
    • When asked if CNN was going to use “fear” to push their agenda, Chester said, “Yeah. Fear sells.”

    In videos released on Wednesday evening, Chester said:

    • “Any reporter on CNN — what they’re actually doing is they’re telling the person what to say… It’s always like leading them in a direction before they even open their mouths. The only people that we [CNN] will let on the air, for the most part, are people that have a proven track record of taking the bait.”
    • “I think there’s an art to manipulation…Inflection, saying things twice — there’s little subtleties to how to manipulate people…I mean, it’s enough to change the world, you know?”
